Required Before Your First Session
For Women 35+ Who Refuse to Shrink
This Agreement is entered into by and between the undersigned Client and The Resilient Woman ("Practice"). The Practice provides physiology-based wellness coaching, functional wellness education, and health coaching for women age 35 and over.
Services may include general lifestyle and eating-pattern education, supplement information for educational purposes, lifestyle coaching, stress support, metabolic education, hormone-support education, general wellness consulting, sleep education, energy regulation education, stress physiology education, recovery education, digestion education, habit and behavior-change education, and general movement guidance. All services are educational and instructional in nature and are not intended to diagnose, treat, cure, or prevent any disease.
The Practice does not provide medical diagnosis or treatment. Client understands that services do not replace medical care. Client agrees to maintain a relationship with a licensed healthcare provider and to consult such provider before making significant dietary, supplement, medication, exercise, or lifestyle changes.
Movement suggestions are provided as general verbal and educational guidance, which may include references to third-party instructional resources (such as demonstration videos) for Client to review and practice independently. Sessions do not include live physical supervision, hands-on instruction, or in-person coaching of movement or form.
Client understands that participation in general movement guidance, including but not limited to bodyweight exercises, stretching, and mobility-based activities, involves inherent risks, including but not limited to muscle strains, joint discomfort, falls, dizziness, and in rare cases, more serious injury. Client voluntarily assumes all such risks.
Client affirms that they are physically able to participate and will immediately inform the Practice of any pain, discomfort, dizziness, or unusual symptoms during sessions.
Client understands that general eating-pattern adjustments, supplement information, and wellness education discussed in coaching may involve individual responses including but not limited to digestive upset, allergic reactions, medication interactions, or other unintended effects. Client voluntarily assumes all associated risks and agrees to consult a licensed healthcare provider before making any changes involving supplements or medications.
Client consents to receive services via telehealth platforms including video conferencing, messaging, or phone. Client understands potential risks including technology interruptions or data breaches and accepts these risks.
When mutually agreed upon, in-person sessions take place in a public location (such as a coworking space or hotel lobby) selected for mutual convenience and safety, rather than a dedicated practice location. Client assumes all risks associated with travel to and from the agreed location and with meeting in a public setting. Client agrees to select a meeting time and location they are personally comfortable with, and it is recommended that Client inform a trusted contact of their meeting details as a general safety practice. In-person sessions are offered at an additional fee, disclosed prior to booking.
Client affirms that all health information provided is accurate and complete to the best of their knowledge. Client agrees to inform the Practice of changes in diagnoses, medications, injuries, or symptoms. All implementation decisions are made solely by the Client.
Payment is due in full prior to the start of services unless otherwise agreed in writing. Packages, programs, and consultations must be paid according to the agreed payment schedule. Failure to complete payments may result in suspension of services.
Due to the educational and service-based nature of the programs and immediate access to intellectual property, all sales are final. No refunds will be issued for completed sessions, partially used packages, downloadable materials, digital programs, missed sessions, or failure to implement recommendations. Exceptions, if any, are at the sole discretion of The Resilient Woman.
Client knowingly and voluntarily assumes full responsibility for any risks, injuries, losses, or damages, known or unknown, arising from participation in services.
To the fullest extent permitted under North Carolina law, Client releases and holds harmless The Resilient Woman, its owner, contractors, affiliates, employees, and representatives from any claims, liabilities, damages, actions, or causes of action arising from participation in services.
Client agrees to indemnify and defend The Resilient Woman against any claims or legal actions arising from Client's decisions, implementation of recommendations, participation in sessions, or failure to seek appropriate medical care.
Client acknowledges that no specific outcomes are guaranteed. Results vary based on individual compliance, effort, biology, and external factors.
This Agreement shall be governed by the laws of the State of North Carolina. Any disputes shall be resolved exclusively in North Carolina courts.
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
Client affirms that they are at least 18 years of age, have read this Agreement in full, understand its contents, and voluntarily agree to its terms.
